Gerdom Realty & Investment (“Gerdom Realty,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, share, and protect information when you visit www.gerdomrealty.com (the “Site”), submit a form, or communicate with us by phone, email, or text message. It applies to our commercial real estate brokerage, landlord and tenant representation, land and development, and property management services.

4. Text Messaging (SMS) Program

Consent

We send text messages only to individuals who have given express written consent by affirmatively opting in — for example, by checking the SMS consent box on one of our forms and providing a mobile number. Consent is never assumed, and our opt-in checkbox is never pre-checked. Consent to receive text messages is not a condition of purchase or of any service we provide.

What we send

Messages may include replies to your inquiries, showing and appointment confirmations and reminders, listing and property updates, lease and transaction status updates, and operational or maintenance notices relating to properties we manage.

Frequency, rates, and opting out

• Messaging frequency may vary.
• Message and data rates may apply. Gerdom Realty & Investment does not charge for text messages; any charges from your mobile carrier are your responsibility.
• You can opt out any time by texting STOP. After you text STOP we will send a single confirmation message and will not text you again unless you opt in a second time.

• Mobile carriers are not liable for delayed or undelivered messages.

Mobile information is not shared or sold

Gerdom Realty & Investment does not share or sell your mobile number, your SMS opt-in, or your text messaging consent to any third party or affiliate for marketing purposes. Mobile information collected for text messaging — including your mobile number and the fact of your consent — is used solely to deliver the messages you have asked to receive.

No mobile opt-in information is included in any of the information sharing described in Section 5 of this policy, and we do not provide it to any third party for that party's own marketing, advertising, promotional, or lead- generation purposes.

The only parties that handle this information are the messaging service providers and telecommunications carriers that transmit messages strictly on our behalf. They are permitted to process your mobile number only to deliver the messages you have consented to receive, and are contractually prohibited from using it for any other purpose.

Email and text preferences are separate

Email and text message preferences are managed independently. Unsubscribing from our emails does not opt you out of text messages, and texting STOP does not unsubscribe you from email.

We do not sell your personal information. We share information only in the following limited circumstances:

• Service providers. Vendors that host the Site, deliver email, maintain our customer records, or provide messaging services on our behalf — in each case limited to what is needed to perform that service.
• Transaction participants. Where necessary to carry out a real estate transaction or management engagement you have asked us to handle — for example landlords, tenants, property owners, lenders, title companies, attorneys, inspectors, or contractors.
• Legal and protective purposes. Where required by law, subpoena, or court order, or where necessary to establish or defend legal claims or protect the rights, safety, or property of Gerdom Realty, our clients, or the public.
• Business transfer. In connection with a merger, acquisition, financing, or sale of assets, subject to the protections of this policy.

As stated in Section 4, mobile numbers and SMS opt-in data are excluded from all of the sharing described above, other than transmission by our messaging providers on our behalf.

We may use analytics services that collect aggregated, non-identifying usage information on our behalf. Our services are directed to businesses and to adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.

• Intellectual property. The Site's content, marks, and materials are owned by Gerdom Realty & Investment or its licensors and may not be reproduced without permission.
• Messaging terms. The text messaging terms in Section 4 apply to all SMS communications with us.
• Governing law. These terms are governed by the laws of the State of Michigan.
